Please note that further terms and conditions govern the purchase of any goods or services described on our website, such as our fee-for-service content marketing and visual scribing services. If you have contracted with our business for such goods or services, please refer to your personalised Client Agreement sent to you via email as the governing set of terms and conditions for our legal relationship.
Your use of this website and membership (free and Pro) are subject to the following terms and conditions:
1. General use of our website
The content of this website is for your general information and use only and is subject to change without prior notice. The content on this website includes all articles, blogs, infographics, videos, podcasts, pages, and other like-minded media.
You can only ever use our website for lawful purposes (such as researching our goods and services or contacting us) in a manner consistent with the nature and purpose of the website, and in a way that doesn’t impact on anyone else’s use and enjoyment of the website. We have a zero-tolerance policy for users who conduct themselves unlawfully or encourage such conduct, who post any defamatory, obscene, offensive or scandalous material, harass or cause distress or inconvenience to any person, or disrupt the website. We reserve the right to ban any users who engage in such behaviour.
You’re not permitted to change, add to, remove, deface, hack or otherwise interfere with our website or any material or content displayed on the website, or attempt to do any of those things.
Unauthorised use of this website may be a criminal offence and/or give rise to a claim for damages.
2. Membership Terms and Conditions
To register as a member of the Resource Library or to purchase products or services from the Resource Library, you must be 16 years older or be of an age in a jurisdiction where you can consent to signing contracts. You agree that the information provided to us upon registration, or purchase of any products or services from the Library, will be true, accurate, current and complete. You also agree to keep this information accurate and up to date at all times, especially your email address as that will be our primary method of contacting you and your orders.
Members of the Resource Library (free and Pro) are deemed to be natural persons. Companies or entitles that are not natural persons are not allowed to hold membership of the Resource Library. Memberships are currently only available on an individual basis.
As a free member, you are entitled to your own individual profile, the ability to bookmark resources and create and share posts on our forum platform. Pro members
When you register as a member, you will be asked to provide a password. You are responsible for safeguarding the password and not disclosing it to other parties. You agree that you will be solely responsible for any activities or actions under your password. You shall notify Neurodiversity Media immediately via our contact details at the end of this agreement if there has been any unauthorised use of your password.
2.3 Payment for Pro Membership
A registered member may upgrade to Pro membership by upgrading on our Pro page after registering as a free member, or by clicking the "Upgrade to Pro" page that is available on the dashboard on the right hand side of the website. By filling in the details of our credit card form, secured by Stripe, a registered member will become a Pro member.
All Pro memberships are charged on annual basis in Australian dollars only. For all international consumers, you are responsible for all currency conversions charged by your financial institution.
Pro Membership of the Resource Library automatically renews on an annual basis on the first of the month that you purchased the Pro membership. For example, if you bought the subscription on 31st August 2020, your annual subscription will automatically renew on the 1st of August 2021. If we are not able to charge your credit card for annual payment, we may immediately suspend your membership until payment is made.
We currently only offer annual subscriptions via credit card payment. We use Stripe as our credit card processor and all credit card details are secured by Stripe, not by Neurodiversity Media. After purchase, you will receive confirmation from Stripe that your payment has been securely processed, with the option to download an invoice as a record of your payment. For National Disability Insurance Scheme (NDIS) recipients, this invoice is your record of payment.
You can cancel your subscription anytime by emailing our contact details below to arrange cancellation. However, you will not be entitled to a refund, pro-rata or otherwise, once you have purchased our Pro membership because of a change of mind. We will only offer refunds based on the grounds outlined under the Australian Consumer Law.
Should an organisation like to purchase Pro memberships as a discounted bundle for their group, please contact us on the contact details below. Group memberships will be subject to tailored terms and conditions.
Neurodiversity Media reserves the right to change the benefits outlined by Pro Memberships, including the price, range of services and products offered, as well as types of discounts offered, at any time for any reason.
2.4 Use of Forum
We maintain a forum on the Neurodiversity Media website. As a registered member of the Resource Library, you have the opportunity to create posts and leave comments engaging with other members. Please note that we may regularly screen and review comments in the forum. We reserve the right to remove comments that we consider may not align with our brand values. You are expressly prohibited from posting any comment or content that is defamatory, offensive or otherwise inappropriate. You warrant that all information that you submit to the forum is true and correct, to the best of your knowledge and information, and that you are the rightful owner of all intellectual property rights in such information.
We reserve the right to restrict members from posting on forums, or deactivating or suspending whole forum boards without giving warning. We expect all our members to abide to general rules of conduct on this forum. These general rules are set out below.
Registered members of our website agree NOT to use our forum:
for any unlawful purpose
to upload or post material considered obscene, offensive, blasphemous, pornographic, unlawful, threatening, menacing, abusive, harmful, an invasion of privacy or publicity rights, defamatory, libelous, vulgar, illegal or otherwise objectionable
to upload or post any material that infringes any copyright, trade mark, patent or other intellectual property right or any moral right or third party right, including but not limited to, Neurodiversity Media, or to facilitate the unlawful distribution of copyrighted or illegal content.
to harm minors in any way, including, but not limited to, posting content that violates child pornography laws, child sexual exploitation laws or laws that prohibit depicting minors engaged in sexual conduct, or any personally identifiable information linked to a child under the age of 13
to upload or post material that causes harm to Neurodiversity Media or anyone else's computer systems, including but not limited to any virus, code, worm, data or other files or programs designed to damage or allow unauthorised access to the Resource Library which may cause any defect to the provision of the Resource Library.
for any commercial purpose, unless approved by Neurodiversity Media through prior commercial agreement
to sell access to the Pro membership of the Resource Library on any other website, without coming to Neurodiversity Media first to discuss any transfers of membership.
2.5 Contributions to the Resource Library
We may sometimes ask our users to contribute content to our Resource Library. Please note before you do so that any material you send to us (including any data, questions, comments, suggestions, ideas, designs, images, videos, audio, marks or other information) will be deemed to be non-confidential and non-proprietary, unless you tell us otherwise. You authorise us to use it for any purpose, without compensation to you, unless we have specifically reached an agreement with you for ongoing work in a freelance or employment capacity.
We also reserve the right to monitor our forum to re-use any user-generated content on the forum that can be curated into additional content for the purpose of updating our Resource Library with the latest knowledge curated from our members.
We may also feature guest writers or creators from time to time. We want you to know that we don’t necessarily endorse or support any views, opinions, standards or information expressed in any work created by guest writers or creators.
If you find something offensive or inappropriate, please don’t hesitate to get in touch with us and we’ll review the material to see whether it should be removed.
2.6 Product Purchases or Services
From time to time, the Resource Library, operating as an e-commerce marketplace, will offer goods or services that come with a retail recommended price (RRP). This is a standard price that is available for purchase for all registered members, free or Pro, as well as non-registered users.
All payments for goods or services are to be made in Australian dollars and prices are subject to change at any time. Postage and applicable sales taxes, such as the Australian Goods and Services Tax, will be added to your order during the checkout process. Any delivery dates provided are an estimate only.
The purchase of such goods or services are governed by the Australian Consumer Law. In general, we will only engage in the return of goods or refund of services according to the regulations as set out by the Australian Consumer Law. On of the benefits of Pro membership is our offer of dynamic discounting of between 10-50% based on the number of Neuros (our points based system) that you have accumulated through participation on our platform. Please refer to clause 2.8 on Neuros for further details.
You acknowledge, as a Pro member, that these progressive dynamic discounts will only apply to your individual member profile and to individual products or services.
2.7 Advertising, Sponsorships and Third Party Offers
Paid advertising within the Resource Library, the NeuroWork newsletter, the Neurodiversity Media website, the NeuroWork Pod, and any other medium or vessel for carrying advertising, will be subject to individual terms and conditions negotiated between Neurodiversity Media and the party seeking paid advertising on our platform.
From time to time, we may offer sponsorship of certain spaces within the Resource Library platform to organisations. These sponsorship agreements will be subject to individual terms and conditions between Neurodiversity Media and the organisation, in addition to the terms and conditions outlined here.
From time to time, we may also embark on partnerships with third parties. As a registered member, you may be able to access these offers. You have no obligation to redeem those offers, but if you do so, they may be subject to the terms and conditions offered by the third party, not by Neurodiversity Media. We will do our best to check the accuracy of the offer descriptions, but suppliers of our third party offers are ultimately responsible for representations in those descriptions, but we do not endorse or assume responsibility for those products or services.
Registered members of the Resource Library who may offer goods or services are not permitted to offer or sell their goods or services on our Resource Library platform or website without the explicit consent of Neurodiversity Media, and subject to a commercial agreement. Any members who do so will have their membership revoked.
2.8 Neuros Terms and Conditions
To incentivise member contribution, we have a program known as the Readers to Leaders program, where members of the Resource Library (free and Pro) can earn points (which we have dubbed "Neuros") for contributions to the Resource Library and the broader Neurodiversity Media program.
Our Readers to Leaders program includes four tiers: Readers, Friends, Allies and Leaders. The general terms and conditions of Neuros are as follows:
Only registered members of the Resource Library may receive Neuros for their participation in the community. Free members may receive non-monetary rewards for reaching certain levels, however Neurodiversity Media reserves the right to change, at any time, the type of rewards made available to free registered members.
Only Pro members of the Resource Library (those who have bought a $99 subscription) will unlock progressive dynamic discounts of 10-50% for goods and services on the Resource Library through the receipt of Neuros for their participation in the community.
You are not allowed to obtain Neuros in exchange for cash or money, and any attempt to do so will result in cancellation or suspension of your membership.
Your only method of obtaining Neuros is to participate in our forum, contribute to our Resource Library, update your profile with relevant resources and other types of conduct that we can prescribe over time. The scope, variety, types of products and services, that may be available for the purpose of the progressive, dynamic discounting can change at any time.
Neurodiversity Media reserves the right to modify, at any time, the number of Neuros required to reach each tier at any time to unlock discounts and rewards.
Neurodiversity Media reserves the right to add or remove any discounts or rewards linked to each tier of the Readers to Leaders program. There will be no retrospective gifting of rewards or discounts
2.9 Termination or Cancellation of Membership
You can cancel your subscription anytime by emailing our contact details below to arrange cancellation before the next date of the annual billing cycle. However, you will not be entitled to a refund, pro-rata or otherwise, once you have purchased our Pro membership because of a change of mind. We will only offer refunds based on the grounds outlined under the Australian Consumer Law.
Neurodiversity Media also reserves the right to cancel the free or paid memberships of members that have either violated our general rules of conduct in our forum.
3. Intellectual Property
This website contains material which is owned by or licensed to us. This material includes, but is not limited to, the content, design, layout, appearance, look, graphics, text, logos, button icons, video images, audio clips, code, scripts, design elements and interactive features of the website, and is protected by copyright under the laws of Australia and through international treaties.
Unless we say otherwise, all rights (including copyright) in the website and are owned or controlled by us and are reserved by us.
Any reproduction of the website or website content is prohibited other than in accordance with these terms.
All designs, trade marks, service marks and trade names are owned, registered and/or licensed by us, save for any trademarks reproduced on this website which are not the property of or licensed to us, which are acknowledged on the website.
